Service Eligibility

clarITy’s services are designed primarily for older adults and seniors aged 55 and above. By using our services, you confirm that you are at least 55 years of age or are participating with prior approval from clarITy.

clarITy reserves the right to limit or refuse services where participation falls outside the intended scope of our programs and services.

Your Website Obligations

In consideration of your use of this Site, you agree that to the extent you provide personal information to clarITy, it will be true, accurate, current, and complete and that you will update all personal information as necessary. You agree to use this Site in a manner consistent with any and all applicable rules and regulations. You agree not to upload or transmit through this Site or mimic this Site to transmit any computer viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer. Any unauthorized modification, tampering or change of any information, or any interference with the availability of or access to this Site is strictly prohibited. We reserve all rights and remedies available to us.

Your Learning Obligations

You agree to participate in all tutoring sessions, communications, and interactions in a respectful, professional, and courteous manner. Harassment, intimidation, aggressive behaviour, discriminatory conduct, verbal abuse, threats, or any form of inappropriate conduct toward tutors, staff, or other participants will not be tolerated. clarITy reserves the right to suspend or terminate services for any individual engaging in behaviour deemed disruptive, unsafe, or disrespectful.

Learning Outcomes

clarITy strives to provide supportive and personalized tutoring services; however, learning progress and results may vary depending on the individual, participation, practice, technology being used, and other factors. clarITy does not guarantee specific learning outcomes, certifications, or technical results.

Cancellations and Refunds

At clarITy, we strive to provide supportive, personalized, and effective technology tutoring services. We understand that schedules and learning needs may change, and we aim to maintain a fair and respectful policy for all participants and tutors.

Clients may reschedule a tutoring session by providing at least 24 hours’ notice prior to the scheduled session time. Cancellations made with less than 24 hours’ notice, missed sessions, or no-shows may not be eligible for rescheduling, as tutors reserve time specifically for scheduled appointments. Exceptions may be considered in cases involving emergencies or unforeseen circumstances.

If a client feels that the tutoring services did not reasonably support or help them progress toward their stated learning or technology goals, such as improving confidence using devices, software, online tools, or digital services, they may contact clarITy to discuss their concerns. Refund requests related to service satisfaction will be reviewed on a case-by-case basis, and clarITy may offer a partial or full refund where appropriate.

clarITy reserves the right to refuse refunds in situations involving misuse of services, repeated late cancellations, inappropriate conduct, or violations of our Terms of Service.

Approved refunds will generally be processed using the original payment method within 10 business days.

Content and Learning Materials

clarITy may provide access to lesson materials, guides, tutorials, videos, worksheets, or other educational resources for personal, non-commercial use. All materials provided by clarITy remain the property of clarITy unless otherwise stated.

You may not copy, reproduce, distribute, sell, share, or modify clarITy materials without prior written permission. You also agree not to use clarITy content in any unlawful, misleading, or unauthorized manner.

Ownership of this Site

This Site, including all its Content are protected under applicable intellectual property and other laws, including without limitation the laws of Canada and other countries. All Content and intellectual property rights therein are the property of clarITy or the material is included with the permission of the rights owner and is protected pursuant to applicable copyright and trademark laws. The presence of any Content on this Site does not constitute a waiver of any right in such Content. You do not acquire ownership rights to any such Content viewed through this Site. While clarITy strives to provide accurate information, reliable services, and a positive learning experience, we cannot guarantee that the website will always be uninterrupted, error-free, or free from technical issues. All website content and services are provided on an “as available” basis.

To the fullest extent permitted under applicable laws in British Columbia and Canada, clarITy is not responsible for indirect, incidental, or consequential losses or damages arising from the use of our website or services. Governing Law, Jurisdiction and Venue

These Terms of Use will be governed under the laws of the Province of British Columbia, Canada without regard to any conflict of law principles. You agree that any action at law or in equity arising out of or relating to these Terms of Use that is not subject to arbitration shall be filed, and that venue properly lies, only in provincial or federal courts located in the province of British Columbia, Canada and you consent and submit to the personal jurisdiction of such courts for the purposes of litigating such action. However, we retain the right to bring an action in any jurisdiction where we believe that infringement of these Terms of Use is taking place or originating.

Indemnity

You agree to indemnify and hold clarITy, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of this Site in violation of these Terms of Use and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or if any material that you post causes us to be liable to another. We reserve the right to defend any such claim, and you agree to provide us with such reasonable cooperation and information as we may request.
